Building Information Modeling (BIM) signifies a pivotal shift in construction project delivery. With this digital revolution, comes a discussion on the Model as a Legal Document (MALD). While MALD holds the promise of improved clarity and efficiency, it also introduces new challenges in risk allocation and management. This session dives into the MALD discussion, seeking to elicit a discussion of the pros and cons of MALD. Traditionally, 2D drawings were incorporated as contract documents, with BIM models as complementary. In MALD, the model replaces 2D plans in the contract. This transition, although beneficial in many aspects, poses unique challenges. The speaker will introduce the topic, and elicit a structured conversation, exploring: BIM versus 2D: level of completion versus ambiguities. Matching design intent to contractual expectations. The role of BIM in dispute resolution. Clarifying ambiguities: determining who can modify the model and when. Identifying the contract model amongst multiple iterations. Balance experience and technology. Concluding our exploration, participants will have a deeper understanding of MALD’s impact on project risk, arming them with the knowledge to make informed decisions in BIM-driven projects.
